Back to Florida guides

Florida veterans have access to a growing network of legal resources designed to address the unique challenges that come with military service. Whether you need help with a VA benefits appeal, are navigating the criminal justice system through a veterans treatment court, face housing or employment discrimination, or need assistance with a discharge upgrade, Florida has programs and organizations ready to help — often at no cost.

This guide covers every major legal resource available to Florida veterans, including the state's expanding veterans treatment court system, free legal aid programs, Florida Bar veteran-focused initiatives, and protections under both federal and Florida law.

Veterans Treatment Courts

Florida Veterans Treatment Courts

Florida has one of the most extensive veterans treatment court networks in the nation, with veterans treatment courts operating in more than 30 counties. These specialized court programs divert eligible veteran defendants from traditional criminal prosecution into treatment-oriented supervision that addresses the root causes of their involvement with the justice system, including PTSD, traumatic brain injury, substance abuse, and other service-related conditions.

Services typically include mental health and substance abuse treatment, VA healthcare enrollment, mentorship from veteran volunteers, housing and employment assistance, and regular court appearances before a veteran-friendly judge. Successful completion can result in dismissed charges or reduced sentences.

Eligibility: Generally open to veterans and active-duty service members charged with felonies or misdemeanors where military service-related conditions contributed to the offense. Contact your local county courthouse to determine if a veterans treatment court is available in your jurisdiction.

Free Legal Assistance

Florida Bar Military and Veterans Legal Assistance

The Florida Bar sponsors programs connecting veterans with pro bono attorneys for civil legal matters including family law, housing disputes, consumer protection, estate planning, and benefits claims. The Florida Bar's Military Affairs Committee coordinates legal clinics and referral services throughout the state.

Bay Area Legal Services — Veterans Legal Assistance Program

Bay Area Legal Services operates a dedicated Veterans Legal Assistance Program serving veterans in the Tampa Bay region. Services include free legal representation in housing, family law, consumer, and public benefits matters. The program also provides VA benefits claim assistance and discharge upgrade support.

Phone: (813) 232-1343 | Serves Hillsborough, Pasco, Pinellas, Manatee, and Sarasota counties.

Legal Aid Service of Broward County — Veterans Project

This program provides free legal services to veterans in South Florida including representation in housing, family law, and public benefits cases. Contact (954) 765-8950 for intake.

Jacksonville Area Legal Aid — Veterans Legal Project

VA Benefits Appeals

Board of Veterans' Appeals

If your VA claim was denied, you have three appeal options: Supplemental Claim (new evidence), Higher-Level Review (same evidence reviewed by a senior claims adjudicator), or Board of Veterans' Appeals (formal appeal with a Veterans Law Judge). Florida veterans can attend Board hearings in person in Washington, D.C. or by video teleconference at the St. Petersburg VA Regional Office.

National Veterans Legal Services Program (NVLSP)

NVLSP provides free legal representation to veterans appealing VA benefits decisions. They handle cases before the Board of Veterans' Appeals and the U.S. Court of Appeals for Veterans Claims. They also train pro bono attorneys throughout Florida.

Discharge Upgrades

Veterans with other-than-honorable or general discharges may be eligible to apply for a discharge upgrade through the Discharge Review Board (DRB) or Board for Correction of Military Records (BCMR). An upgraded discharge can unlock access to VA healthcare, disability compensation, GI Bill education benefits, and other programs. Several Florida legal aid organizations provide free assistance with discharge upgrade applications.

Legal Protections

Servicemembers Civil Relief Act (SCRA)

The SCRA provides federal legal protections for active-duty service members including interest rate caps, eviction protection, lease termination rights, and protection from default judgments. Florida courts are required to enforce SCRA protections.

USERRA (Uniformed Services Employment and Reemployment Rights Act)

USERRA protects veterans' and service members' civilian employment rights. Employers must reemploy returning service members in the position they would have attained absent military service. Florida also provides state-level employment protections for military members.

Florida Veterans' Preference Enforcement

Florida law gives the Florida Department of Veterans' Affairs enforcement authority over veterans' preference in employment. If a veteran believes a state or local government employer violated veterans' hiring preference, a complaint can be filed with FDVA. This is a uniquely strong enforcement mechanism compared to many other states.
